Your privacy is important to us. UNITED RUNNERS CLUB (the “Collective”) and, AscendFS Delaware, Inc. (“Ascend” and together with the Collective, “we”, “us” or “our” as context dictates), and we want you to feel comfortable using the On to Victory Program and the services provided via https://www.goutsa.co/ including but not limited to all content, services, and products available through such site (the “Program”) as it is described and outlined in the Program Terms (https://www.goutsa.co/terms-and-conditions) view of this we have created this Program Privacy Policy as an addendum to Ascend’s global Privacy Policy (https://www.ascendfs.com/privacy-policy) and the Collective’s global Privacy Policy https://www.goutsa.co/privacy-policy) which applies to any person using the Program and shall be read in conjunction with our respective Privacy Policies. In case of any conflict between our Privacy Policies and terms of this Program Privacy Policy, this Program Privacy Policy shall prevail.

1. DEFINITIONS

Card” means an Eligible Card.
collect” means to gather, acquire, or obtain personal information form any source, including third parties.
consent” means a voluntary agreement with what is being done or proposed. Consent can be “express” through words or by specific acts or “implied”, to the extent permitted by applicable law, by the conduct of the individual whose personal information is being collected, used, or shared. Unless we determine that we require an additional consent for specific products, services, programs, contests, promotions, or events, you agree and consent that as a provider of personal information we may collect, use, share, or otherwise process your personal information in accordance with this policy.
Eligible Cards” means any US Visa, American Express or Mastercard credit cards and as may be amended from time to time.
Enrolled Card” is a Card that is accepted into the Program to benefit from Program services. Only Eligible Cards (defined herein), are eligible to benefit from the Program.
Payment Network” means Visa, Mastercard and other payment network companies which participate in the Program.
Personal Information” means information about an identifiable individual, and includes without limitation information that we can reasonably use to directly or indirectly identify you such as your name, email address, phone number, mailing or billing address, payment information (e.g. payment account number), geolocation, browsing history, IP address, login/username or other similar identifier, and any other identifier we may use to contact you.
Program Account” means the account that you set up to sign up and maintain the card-linked rounding Program and services.
Program Terms” means the Terms and Conditions you must agree to before using the Program.
User”, “you” and “your” refer to the person that is using our service, and for whom an account number has been established or is being established in our databases and/or that has visited or is using https://www.goutsa.co/ and/or the Program.

2. GENERAL

In order to provide to you the benefits of the Program, we need to collect information, which may also include your Personal Information or data, as defined herein and under applicable law. Please be aware that your browsing of our website and your use of the Program may also result in collection of certain information on account of technologies detailed in this Program Privacy Policy.

3. INFORMATION WE COLLECT THROUGH THE PROGRAM

We collect and use several types of Personal Information from and about you for the Program, including:

Personal Information that you provide directly to us:
Contact Data. We collect information or content you provide to us in connection with an account, such as when you register for a Program Account or contact us for support. Examples of contact data we may collect include your name, email address, phone number, mailing address, Program Account login name and password.
Demographic Data. We may collect demographic data when you fill out forms or surveys or sign up for and participate in events, contests, sweepstakes, promotions, and special programs that we provide. Examples of such information include age and gender.
Communications Data. We collect information when you communicate with us or others on our Services, such as when you request additional information about the Program, interact with our customer service team or sign up to receive our email newsletters or marketing messages. We also collect communications data when you interact with us on social media, such as by tagging us or permitting us to follow your social media profile. Examples of such data may include your contact information, the date and time of your communications, online identifiers, social media profile, and the content of your communications. We provide an opportunity for you to unsubscribe or opt-out of communications on an ongoing basis by using the unsubscribe mechanism at the bottom of our e-mails, if applicable, SMS messages or by e-mailing to changeitops@ascendfs.com

Personal Data We Collect Automatically
We automatically collect certain personal data when you enroll into and use our Program. The types of information we collect may include:

Device and Network Data. We collect certain information about the device you use to access our Services. Examples of such data include your device’s hardware model, browser type and version, time zone setting, IP address, operating system version, unique device identifiers, advertising identifiers, serial numbers, usage and traffic data, network information, and mobile network data.

Technical and device information, including your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform, or information about your internet connection, the equipment you use to access the Program, your device’s unique identifiers (e.g. UDID, IMEI, MAC address), IP address and geo-location data, and usage details.

Usage Data. We may collect information about your activity on our Services via log files, cookies, web beacons, and other tracking technologies. Examples of such data include your access dates and times, pages or screens viewed, how long you spent on a page or screen, the routes by which you access our Services, information about your activity on a page or screen, app crashes and other system activity, your use of any hyperlinks available within our Services, information about your interactions with our emails, your Internet service provider (ISP), Mobile Advertising ID, media access control (MAC) address, and identifiers associated with browser cookies, web beacons, and similar technologies we deploy on our Services (for more information about cookies and how to disable them, see the COOKIES section below).

Location Data. We collect precise or approximate location information in accordance with your device permissions. You may use our Services without enabling us to collect location data from your device, however, this may affect some functionality available in the Services.

Personal Data we collect from other sources
When your Card is enrolled with the network, it is done so securely and directly with the Payment Network attached to your Card. A unique identifier, a token, representing your Enrolled Card is used by us, the Program Vendors, and any other of our technology partners or other third party partners who may need to use such unique identifier in order for us to provide the Program to you. No one but the Payment Network will ever see your credit card number or related details. After enrollment, your unique identifier will be shared between us, the Program Vendors and the Payment Network associated with your Enrolled Card. No additional Personal Information is shared with these third-parties about your Program Account.

Cookies
We may also use “cookies” to collect information and improve the Program. A cookie is a small data file that we transfer to your device. We may use “persistent cookies” to recall a previously authenticated session. We may use “session ID cookies” to enable certain features of the Program, to better understand how you interact with the Program, and to monitor aggregate usage and web traffic routing through the Program. However, none of this is associated with you as an individual. If measured, it is measured only in aggregate. Cookies do not capture your individual email address or any private information about you. You can instruct your browser, by changing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. If you do not accept cookies, however, you may not be able to use all aspects of the Program.

4. HOW WE USE YOUR INFORMATION

We use information that we collect about you or that you provide to us, including any Personal Information:
- to present the Program and its contents to you, including marketing communications (if you elect to receive those);
- to fulfill the benefits of the Program to you.
- to fulfill the purposes for which you provided the information or that were described when it was collected, or any other purpose for which you provide it;
- to provide you with notices about your Program Account, including expiration and renewal notices;
- Communicate with you, such as to advise you of changes to the Program, respond to your questions, and address customer service matters
- to carry out our obligations and enforce our rights arising from any contracts with you; including for billing and collection or to comply with legal requirements;
- to improve our Program, products or services, marketing, or customer relationships and experiences;
- in any other way we may describe when you provide the information; or
- for any other purpose with your consent.

Using the information gathered about you over time by us or our service providers as described above, we may engage in interest-based advertising, or “online behavioural advertising”, which includes ads presented to you after you leave the Program that encourage you to return. These ads may also include offers we think are relevant to you based on your shopping habits or online activities, and they may be served on websites or applications. We may serve these ads, or third party advertisers and ad networks may serve you these ads. Many of these third parties have opt-out mechanisms for their ad cookies. Personal Information that we derive:
Analytics information that does not directly or indirectly reveal your identity or directly relate to an identifiable individual, such as statistical or aggregated information. Statistical or aggregated data does not directly identify a specific person, but we may derive non-personal statistical or aggregated data from Personal Information. For example, we may aggregate the Personal Information of a number of Users to calculate the percentage of Users accessing a specific feature of the Program.

5. SHARING OF INFORMATION COLLECTED FOR THE PROGRAM

We may disclose aggregated information about the use of the Program, and information that does not identify any individual, without restriction.
We may disclose Personal Information that we collect or you provide as described below:
- to our subsidiaries and affiliates for the purposes described in the “How We Use Your Information" section above;
- in accordance with applicable law, to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us about our customers and users is among the assets transferred;
- to contractors, service providers (including the Program Vendors), and other third parties we use to support our business and who may assist us in performing services or who may perform services on our behalf, such as our Program Vendors who support the Program, web hosting providers, and analytics and search engine providers that assist us with improvement and optimization of our sites. These service providers are contractually obligated to keep Personal Information confidential, use it only for the purposes for which we disclose it to them, and to process the Personal Information with the same standards set out in this policy;
- to fulfill the purpose for which you provide it. For example, if you give us an email address to use the “email a friend” feature of our sites including https://www.goutsa.co/, we will transmit the contents of that email and your email address to the recipients;

6. DATA RETENTION AND LOCATION

We will retain your Personal Information for as long as you are using the Program, as needed to provide you with the Program, as set out in our respective Privacy Policies or as required by law. We endeavour to store, access, process and use personal information in Canada and/or in the United States. If you wish to cancel your account other than as otherwise set out in the Program Terms or this Program Privacy Policy or request that we no longer use your information to provide you with the Program, contact us at changeitops@ascendfs.com. We may retain and use your personal information after closure of your account as necessary to meet legal, regulatory, insurance, and audit requirements.If you are a Quebec resident, this means your personal information may be transferred outside of Quebec.

If you are a Quebec resident, your personal information may be transferred to disclosed to service providers located outside of Quebec.

7. CHANGES TO THE PROGRAM PRIVACY POLICY

We reserve the right to change, modify, or amend this Program Privacy Policy at any time. Please also read over our Program Terms. We take privacy matters very seriously and intend to stay at the forefront of privacy policy and protection matters. We will occasionally update our Program Privacy Policy and we will post those updates on this page. Your continued use of the Program following a change to this Program Privacy Policy means that you provide your consent to the collection, use and disclosure of your personal information as set out in the updated Program Privacy Policy. 8. PERMISSION FOR COLLECTION OF INFORMATION

9. CHILDREN

The Program and website are not intended for use by minors. Ascend does not knowingly collect Personal Information about minors. By accepting the present Program Privacy Policy and our respective Privacy Policies you are also representing that you are eighteen (18) years of age or above. In case you are under the age of eighteen (18), then please do not share any information including Personal Information. If you believe that we have mistakenly or unintentionally collected a minor’s Personal Information, please contact Ascend’s Privacy Officer.

10. SECURITY OF YOUR PERSONAL INFORMATION

The security of your Personal Information is very important to us and we are committed to protecting the information we collect. However, we cannot take responsibility for theft, misuse, unauthorized disclosure, loss, alteration or destruction of data by a third party (such as a hacker). We have security measures in place at our physical facilities to protect against the loss, misuse, or alteration of information that we have collected from you through the Program.

12. NEVADA PRIVACY RIGHTS

Nevada law permits our Nevada consumers to request that their personal information not be sold (as defined under applicable Nevada law), even if their Personal Information is not currently being sold. Requests are free of charge and may be sent to privacy@ascendfs.com with "Nevada Personal Information Request " in the subject line. We will reply with the requested information within 30 days.
